It is OnfuegO's policy to respect the privacy of Members. Therefore, OnfuegO will not disclose to any third party Member's name or contact information. OnfuegO will also not monitor, edit, or disclose the contents of a Member's information unless required to do so by law or in the good faith belief that such action is necessary to:
- Conform to the edicts of the law or comply with legal process served on OnfuegO;
- Protect and defend the rights or property of OnfuegO;
- Act under exigent circumstances to protect the personal safety of OnfuegO's users or the public;
- Fix or debug problems with the OnfuegO site.
This site may produce automated search results or otherwise link you to other independent third party sites on the Internet. These sites may contain information or material that some people may find inappropriate or offensive. By accepting this agreement and/or submitting any Content, you are guaranteeing to OnfuegO that you are of legal age to enter into contracts (you're not a minor) and have all rights, approvals and/or consents necessary to submit the Content on the terms provided herein. You also guarantee that no permission is required from any other individual or company for us to use the Content and other rights provided herein. You further guarantee to OnfuegO that the compositions, recordings, lyrics and other materials contained in the Content are original, created only by you and do not contain any "samples" or excerpts from the material of others and do not otherwise infringe on the rights of any other individuals or companies.
At all times you shall retain full ownership of the Content while granting to OnfuegO the following non-exclusive rights:

You agree to not use the Service to:
- Upload, post or otherwise transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
- Harm minors in any way;
- Impersonate any person or entity, including, but not limited to, an OnfuegO official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
- Upload to, distribute through or otherwise publish through the Site any Content that is directly or indirectly commercial in nature or contains any solicitation of funds, promotion, advertising or solicitation for goods or Site. You specifically acknowledge that soliciting other users to join or become users or members of any commercial online web site or other organization is expressly prohibited;
- Upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
- Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

You acknowledge that OnfuegO does not pre-screen Content, but that OnfuegO and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service. Without limiting the foregoing, OnfuegO and its designees shall have the right to remove any Content that violates the TERMS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content.
You agree to indemnify and hold OnfuegO, and its makers, friends, or other affiliated persons and entities, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content, your use of the Service, your connection to the Service, your violation of the TERMS, or your violation of any rights of another.
OnfuegO makes no representation that materials on this site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
These TERMS shall be governed by and construed in accordance with the laws of the State of California, USA, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these TERMS or your use of this site shall be filed only in the state or federal courts located in the State of California, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
OnfuegO reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that OnfuegO shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
You agree that OnfuegO, in its sole discretion, may terminate your use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if OnfuegO believes that you have violated or acted inconsistently with the letter or spirit of the TERMS. OnfuegO may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TERMS may be effected without prior notice, and acknowledge and agree that OnfuegO may immediately deactivate or delete your Content and/or bar any further access to such files or the Service. Further, you agree that OnfuegO shall not be liable to you or any third-party for any termination of your access to the Service.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

ONFUEGO EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- ONFUEGO MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
- ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH CONTENT.
- NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ONFUEGO OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
Except where prohibited by law, in no event will OnfuegO be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if OnfuegO has been advised of the possibility of such damages.
If, notwithstanding the other provisions of these Terms of Use, OnfuegO is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, OnfuegO's liability shall in no event exceed the greater of (i) the total of any subscription or similar fees with respect to any service or feature of or on the Site paid in the six months prior to the date of the initial claim made against OnfuegO, or (ii) US$100.00. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
The TERMS constitute the entire agreement between you and OnfuegO and govern your use of the Service, superceding any prior agreements between you and OnfuegO. The failure of OnfuegO to exercise or enforce any right or provision of the TERMS shall not constitute a waiver of such right or provision. If any provision of the TERMS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TERMS remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TERMS must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the TERMS are for convenience only and have no legal or contractual effect.
If you believe that your work has been copied and is accessible on the OnfuegO site in such a manner as to constitute copyright infringement, you may notify us by providing OnfuegO's copyright agent with the following information:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
- Your address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

OnfuegO or any of its employees do not accept or consider unsolicited ideas, including ideas for new promotions, new or improved products or technologies, product enhancements, processes, materials, or marketing and partnership plans. The sole purpose of this policy is to avoid potential misunderstandings or disputes when OnfuegO's products or marketing strategies might seem similar to ideas submitted to OnfuegO. So, please do not send your unsolicited ideas or original creative artwork to OnfuegO or anyone at OnfuegO. If, despite our request that you not send us your ideas, you still send them, then regardless of what your letter says, the following terms shall apply to your idea submission.
TERMS OF IDEA SUBMISSION
You agree that:

OnfuegO does, however, welcome your feedback regarding many areas of OnfuegO's existing business. Please provide only specific feedback on OnfuegO's existing products or marketing strategies; do not include any ideas that OnfuegO's policy will not permit it to accept or consider. It's just one more way that OnfuegO can learn how to best satisfy your needs.
